Tim Scott, Fischer & Phillips

Tim Scott is a partner in the Firm’s New Orleans and Boston offices. His practice emphasizes employment litigation, particularly discrimination, harassment, retaliation, wage and hour, and restrictive covenant claims. Tim has successfully handled a number of jury and bench trials, class and collective actions, arbitrations, and appeals. Tim also provides practical, timely advice to employers on a day-to-day basis on issues relating to compliance with various state and federal labor and employment laws, as well as issues applicable to educational institutions. Additionally, Tim handles traditional labor law proceedings before the National Labor Relations Board (NLRB), particularly union representation cases on behalf of management, and workplace safety and health matters involving the Occupational Safety and Health Administration (OSHA).

Tim is a frequent speaker and trainer on a variety of employment law topics including wage and hour compliance, medical leave and disability laws, and harassment and discrimination claim avoidance. Tim is a core member of the Firm’s Dealership Practice Group. In this regard, Tim represents and advises automobile dealerships across the country on labor and employment compliance issues. He has served as the General Labor Counsel for the Louisiana Automobile Dealers Association since 2006. He is “AV” Peer Review Rated by Martindale-Hubbell, and he has been listed in The Best Lawyers in America since 2012. He has also been listed in Chambers USA, America’s Leading Business Lawyers since 2013.

Tim informed the GNOEA of recent legal updates. He explained that the President reclassified medical marijuana, recognizing it as having accepted medical use. Tim recommended that companies whose operations involve hiring drivers or employees who operate heavy machinery continue to include marijuana in their drug-testing panels rather than excluding it. Tim discussed the use of independent contractors. He recommended that any business engaging independent contractors execute a written contract that clearly defines the scope of work, responsibilities, terms of the engagement, and all other pertinent details to help establish the independent contractor relationship and protect both parties.

Tim advised that businesses may no longer inquire about an applicant’s arrest history on employment applications. However, employers may still ask applicants about felony convictions, as permitted under applicable laws and regulations. Tim also recommends business’ to make sure they complete the I9’s correctly. Tim also provided guidance on managing remote employees. He advised that businesses employing remote workers should ensure they comply with the employment laws and regulations of the state in which the employee resides, as those state-specific requirements may govern the employment relationship.
